1. Separation of married and de facto couples

2. Divorce
We can assist you with applying to the Family Court for a divorce. Our service includes preparing the Court Application for you. We may also be able to apply for a divorce even if you are currently living with your spouse under the same roof. There are extra Court requirements for the Court Application when you are living under the same roof.
A divorce does not settle the parenting arrangements of the children nor the division of property. It is important that you seek advice from our experienced and affordable family lawyer who can inform you of the advantages and disadvantages of different options.
3. Parenting including children’s issues and parenting orders (formerly child custody)
We understand that both parents may prefer to reach an agreement about the living arrangements of their children. As a result, the family can avoid the expense and stress associated with Court proceedings.
We can refer you to community based or private mediation services and assist you with the mediation process. Mediation can lead to the resolution of a dispute. Further, our service includes preparing a document for Court which reflects the agreement reached at mediation. We lodge the document with the Court. Usually, you do not have to appear at the Court.
Alternatively, if there is no agreement then with your consent we can lodge the necessary Court documents and appear on your behalf in Court. The parents can still reach an agreement during the Court process without proceeding to a trial.

4. Property settlements including pre-nuptial agreements
Whether you have separated or thinking of separating it is important to obtain immediate legal advice about your property entitlements. Generally, at the first consultation we can advise you about a correct division of property.
If you have reached an agreement about the division of property it is essential to record the agreement in an enforceable document. The two main types of enforceable documents are Binding Financial Agreements and Consent Orders. We can advise you about which enforceable document is suitable for your situation.
Binding Financial Agreements
There are three occasions for Binding Financial Agreements as follows:
- Before marriage (referred to as pre-nuptial agreements) or before the de facto relationship.
- During a marriage or de facto relationship.
- After a divorce or at the end of a de facto relationship.
We can prepare or review a Binding Financial Agreement so you receive a reasonable property settlement. We do not lodge the Binding Financial Agreement with the Court. Consequently, there is a high level of privacy about your property division.
Consent Orders
A Consent Order is an Order of the Court that reflects your agreement. The Consent Order is for married couples and de facto couples that have separated. An advantage of a Consent Order is that clear enforcement procedures are available if an individual does not comply with a Consent Order.
We can prepare all the documents required to obtain the Consent Orders including lodging the documents with the Court. Generally, there is no requirement for you to appear at the Court.
